Truth is a useless currency at CTTT. Lies seem to pay off at CTTT. I am told that CTTT has no power to deal with liars. Therefore, it seems that anyone who cares to lie and to fabricate documents has the upper hand, and CTTT can’t do a thing about it. So what’s an innocent person supposed to do to defend themselves against blatant unscrupulous liars? Nothing. And CTTT can’t help you due to limitations of powers. So what’s the point in telling the truth?

I wrote to the Chairperson of the Consumer, Trader & Tenancy Tribunal, Ms Kay Ransome, complaining about Mr Sam Cohen of IHRB. I said, ‘Every single word; every single sentence; every single document; and every single letter and statement uttered by [Mr Cohen] to CTTT has been a lie or fabricated (and I can prove it).’ I asked Ms Ransome if it concerned her that a respondent can lie to such a degree. Ms Ransome wrote back saying, ‘With regards to your comments that you believe the respondent made false and/or misleading statements to the Tribunal I can advise that under section 71 of the Consumer, Trader and Tenancy Act 2001 a person must not in any proceedings or application “provide any information, or make any statement, to the Tribunal, Chairperson or Registrar knowing that the information or statement is false or misleading in a material respect.” If you wish to pursue this matter further, you would need to provide me with details of the statements you believe to be false and misleading and the reasons for your belief.’

I sent a range of information to Ms Kay Ransome, including these two articles about lies and about fabrications by Mr Sam Cohen. Ms Ransome kindly responded in a letter dated 13 January 2011 saying, ‘Thank you for the documents you have provided in relation to your allegation that the respondent provided false and misleading information to the Tribunal. The Tribunal plays no regulatory or prosecutorial role regarding such breeches. However, I have referred your allegations to the Deputy Commissioner Fair Trading Operations for assessment pursuant to section 71 of the Act. Fair Trading will advise you of the outcome of the referral.’

It is amazing that CTTT asks applicants and respondents to swear that they will tell the truth. Pray tell, what’s that all about? An oath to tell the truth is a major handicap to anyone who has a conscience. It handcuffs the honest person who is bound to tell the truth, which, no matter how good it might be, is rendered null and void in the face of a person like Mr Cohen who has no hesitation in not only lying, but also attending a hearing armed with fabricated documents. If that is called fair play, then there is no hope for fair trading. So if justice is out the window, and lies can be fabricated on the spot, and if pointing the finger and calling somoene a liar is not permitted, as I was silenced by a Member who did not like me using such words, then I dare say that we are up the creek.

So tell the truth and be done over by those who have no limits, or lie as well and make a potato mash of the whole fine and commendable multimillion dollar infrastructure we call CTTT!

I had always held CTTT in high regard, and I do believe it to be a fine establishment. I have appreciated Ms Kay Ransome’s fast and professional responses, and this article is not a criticism of CTTT. Rather, it shows why and how people like Mr Cohen keep getting away with bad behaviour. There are cracks in any system and loopholes in any net, so the only way to catch Mr Cohen is with persistence and stamina. Add patience and conviction, and we might have a hope of putting a stop to his lies — sooner or later, one way or another. Eventually, such liars trap themselves in a corner.

P.S. IHRB is the name of the Institute of Hair Regrowth and Beauty run by Sam Cohen (Samuel Faraj Cohen) of 105 Pitt Street Sydney. It is also written as Institute of Hair Regrowth & Beauty or Institute of Hair Re-growth & Beauty and the company purports offers hairloss (hair loss) and hair growth treatments.

Days in breach of TGA Orders

As at 19 August 2015, Sam Cohen and IHRB are 544 days in breach of TGA Orders that demanded that IHRB stop its misleading, deceptive, and unlawful claims and to remove its statements from its website. The TGA also Ordered IHRB to publish a retraction on its website. Despite eventually publishing the retraction, IHRB is still in breach of these TGA Orders.
